Notice to members – Amendment to Rules

Members are advised that in accordance with Rule 30 of the Rules of the Shop, Distributive and Allied Employees’ Association, Western Australian Branch (Rules), the Committee of Management have approved an amendment for the inclusion of 12A. The Secretary has applied to the Fair Work Commission to have the Rules amended to reflect the approved amendment, which is as follows:

Proposed rule:

Rule 12A - Presentation of Audited Financial Reports of the Branch

Despite anything to the contrary in these rules, the Branch auditor’s report, the Branch general purpose financial report and the Branch operating report and other documents comprising the full financial reports of the Branch may be presented to the committee of management of the Branch provided that at any time upon demand of 5% of the membership of the Branch a special general meeting of the Branch shall be called and held for the purpose of considering the full financial reports of the Branch.

Reasons for change:

  1. This simplified and fast-track procedure is provided for in the legislation governing the presentation of audited financial reports of the Branch (see sub-s. (3) of section 266, Fair Work (Registered Organisations) Act, 2009.

  2. Adoption of such a rule has been commended to Registered Organisations and their Branches by the Registered Organisations Commission (see Registered Organisations Commission Quarterly Newsletter August 28, 2019 “Tips: Financial Reporting Meetings”.

  3. This procedure does not preclude tabling copies of the full financial reports of the Branch to a special general meeting of members if a sufficiency of members desire such a meeting to be convened or publishing this information on a Branch website or journal if desired by the Branch Committee of Management but adoption of a “5% rule” makes this course not mandatory.
