Notice to members – Amendment to Rules

In accordance with Rule 30 of the Rules of the Shop, Distributive and Allied Employees’ Association, Western Australian Branch (Rules), members are advised that a majority of the Committee of Management have approved an amendment to Rule 19(c) of the Rules. The Secretary has applied to the Fair Work Commission to have the Rules amended to reflect the approved amendment, which is as follows:
Current Rule
19(c) Special meetings shall be called on receipt of a request in writing from one hundred financial members if such request sets out the purpose for which it is desired that the meeting shall be called. Such meetings shall be held within twenty-one days after the receipt of such request, provided that if an ordinary meeting of the Sub-Branch is to be held within one month after the receipt of such request the Branch Secretary may, if he considers it convenient, direct that the special meeting shall be held at the time and place of the next ordinary meeting of the Division.In such case no part of the business of the ordinary meeting shall be commenced until the business of the special meeting is completed, unless the members there present otherwise decide.
Amended Rule
Replace “one hundred financial” with “no less than five (5) per cent of”:
19(c) Special meetings shall be called on receipt of a request in writing from no less than five (5) per cent of members if such request sets out the purpose for which it is desired that the meeting shall be called. Such meetings shall be held within twenty-one days after the receipt of such request, provided that if an ordinary meeting of the Sub-Branch is to be held within one month after the receipt of such request the Branch Secretary may, if he considers it convenient, direct that the special meeting shall be held at the time and place of the next ordinary meeting of the Division.In such case no part of the business of the ordinary meeting shall be commenced until the business of the special meeting is completed, unless the members there present otherwise decide.
Reason for Change
Section 266(3) of the Fair Work (Registered Organisations) Act 2009 (Act) provides that the Branch’s auditor’s report, general purpose financial report, and operating report (together, the Full Report), can be presented to a meeting of the Committee of Management (instead of calling a general meeting of members), provided that the Branch’s rules provide for a specified percentage of not more than 5% of the Branch’s members to be able to call a general meeting to consider the Full Report. The proposed change is necessary to ensure the Branch’s rules are consistent with section 266(3) of the Act.
