Notice to members – Amendment to Rules

Members are advised that in accordance with Rule 30 of the Rules of the Shop, Distributive and Allied Employees’ Association, Western Australian Branch (Rules), the Committee of Management have approved an amendment to Rule 22 of the Rules. The Secretary has applied to the Fair Work Commission to have the Rules amended to reflect the approved amendment, which is as follows:

Current Rule

22 - NEW MEMBERS

a)      An applicant eligible for membership shall fill in the application form provided and forward same together with any prescribed fee to an authorised representative of the Branch who shall forward same to the Branch Secretary.

b)      An applicant for membership shall be informed, in writing, of:

(i)     the financial obligations arising from membership; and

(ii)    the circumstances, and the manner, in which a member may resign from the Association.

c)     Membership shall commence from the date of acceptance of the applicant for membership by the Committee of Management.

Proposed amendment to rule

Insert a new paragraph “b)”, and modify the lettering of the subsequent subparagraphs accordingly:

22 - NEW MEMBERS

a)      An applicant eligible for membership shall fill in the application form provided and forward same together with any prescribed fee to an authorised representative of the Branch who shall forward same to the Branch Secretary.

b)      The Branch Secretary may also establish facilities that enable applicants eligible for membership to make application and pay any prescribed fee using a website or other suitable means.

c)       An applicant for membership shall be informed, in writing, of:

(i)      the financial obligations arising from membership; and

(ii)     the circumstances, and the manner, in which a member may resign from the Association.

d)      Membership shall commence from the date of acceptance of the applicant for membership by the Committee of Management.

Reason for Change

The Rules in their present form only contemplate applicants for membership making application by filling out an application form in writing. The Rules do not specify that the Branch can accept membership applications by other means, for example through the Branch’s website. The proposed change is necessary to ensure the Branch can accept membership applications by website or other means.
